McCunn trial set for August in Clarinda

Judge James Heckerman set a jury trial date for 9:30 a.m. Aug. 5 for a Red Oak man charged with first degree murder of a Shenandoah man. Toby Lee McCunn, 34, allegedly shot 33-year-old Josh Jordan in April at a Shenandoah residence.

According to the affidavit, at approximately 4:45 a.m., on April 22, Shenandoah Police received a 911 call regarding a shooting at 901 Manti Street. Responding officers found Jordan dead inside the residence.

The affidavit alleges McCunn was inside the residence with two other individuals looking for Jordan. When Jordan returned to the residence, McCunn allegedly fired several shots at the victim with a handgun, striking him in the chest, resulting in a fatal wound. Witnesses who called 911 to report the shooting identified McCunn as the shooter.

Shortly after 2 p.m. the same day, McCunn was located at a residence in Shenandoah and taken into custody without further incident. An autopsy was ordered for Jordan by the Iowa State Medical Examiner’s Office in Ankeny.

Public Defender Andrew Munger was assigned to defend McCunn, who has pled not guilty. On McCunn’s behalf, Munger has requested a change of venue, which was denied, as well as a motion for immunity for a witness, also denied. Previously, McCunn waived his right to a speedy trial, but later reasserted that right.

The judge did approve the request for a new trial date, which was set to take place June 25. A pre-trial conference is scheduled for July 22.

Requests for additional information from Page County Attorney Carl Sonksen have not been acknowledged.

When asked for additional information, Munger said to contact Sonksen.

Darrell Simmons, special agent in charge for the Iowa Department of Public Safety-Division of Criminal Investgation said no new information is being releaased to the public at this time.
